The test preparation industry is a multibillion dollar machine that covers everything from the SAT to the GRE, GMAT, and the lucrative LSAT market. TestMasters, the California based LSAT company, was found by Robin Singh and is one of the best companies when it comes to the Law School Admission Test. The other Test Masters, a Texas based firm, specializes in the SAT.
The big problem between the two companies is that the Texas Test Masters owns the domain .com and consumers claim that this firm practices unfair business tactics in obtaining business directed towards TestMasters. Robin Singh has made a living making his business and name a brand with international recognition. There is nobody in the LSAT industry with more knowledge and experience than him. When TestMasters began expanding and gaining in this name brand recognition, the Texas company, since having the popular .com domain, began to receive consumers asking about LSAT prep courses. Instead of explaining that they are not the California company, Test Masters instead designed a website that matched the ideas of the .net to draw business. The only problem with this is that when consumers click on the class they are seeking, they are told the class is closed, and are directed to purchase the Texas based company’s inferior product while denying to consumers that another company does exist.
For example, let’s say there was a company called Brand X and this company became known as being a great product from word of mouth and positively delivering a great product to their customers. Then Brand X decides to build a website and finds there is already a Brand X in the popular .com position. This second Brand X offers similar products to the original Brand X. What happens is that because of the second’s position in the internet market, and because of the increased popularity of the original, Brand X 2 will always get a proportion of the original companies business and if the company pretends to be the original, they will keep a percentage of that traffic.
The main problem besides copying TestMasters’ business plan is that the consumer whom has no idea that there are two separate companies spends hundreds of dollars buying the inferior product, only to learn that they do not have the real company. This ends up costing them time and frustration as the Texas based company will not give a refund and the student does not have time now to sign up for a real LSAT prep course in time for the next LSAT. This one simple act committed by the Texas based company can adversely affect a pre-law student’s admission and acceptance into law school.
